ESTATE PLANNING Estate planning, is the process of making and directing decisions during one’s lifetime, which may not be carried out until the person becomes incapacitated or dies. Some of the goals of estate planning include establishing beneficiaries (those who are to receive the estate upon the death of the one making the estate plan), reducing or avoiding estate taxes, avoiding or minimizing the process of probate, designating guardians/conservators for oneself or for minor children and planning in the event of incapacity. Documents used in estate planning include wills, trusts, powers of attorney (both financial and medical), and advanced directives (sometimes referred to as a living will). While there is no requirement that these documents be drawn up by an attorney, there are many traps and pitfalls which may be sprung on the unwary, and usually these are not realized until a point in time when it is far too late to preserve the intent of the drafter, i.e. after the drafter’s incapacity or death.
